I understand that this ticket is final sale, non-refundable, weather reliant, required for all ages 3 & up, and is valid for a single time entry into the farm during any of our 2023 Pumpkin Fest Season operating dates and hours. This admission ticket cannot be transferred/used towards any other Rockberry Ranch season/event. Season dates may change depending on weather, availability or other unforeseen circumstances. In the event of mechanical failure or inclement weather, Rockberry Ranch may close attractions without notice. I understand that Rockberry Ranch is NOT open Monday - Friday, except for Monday, October 9th and Friday, October 27th during the 2023 Pumpkin Fest Season.

I understand that Rockberry Ranch's U-Pick pumpkins and flowers are dependent on crop availability and is subject to change. By entering Rockberry Ranch, you consent to your voice, name, and/or likeness being used, without compensation, in commercial film or photography in conjunction with Rockberry Ranch advertising and all media whether known or hereafter devised, for eternity, and you release Rockberry Ranch, its successors, assigns and licensees from any liability whatsoever.

TEXAS STATE LAW Agreement and Warning – I understand and acknowledge that an agritourism entity is not liable for any injury to or death of an agritourism participant resulting from agritourism activities. I understand that I have accepted all risk of injury, death, property damage, and other loss that may result from agritourism activity.

​This ticket contract applies to ALL individuals using a ticket to gain access and entry to Rockberry Ranch / JTR Farms LLC at 995 West Gates Valley, Rd. Poteet, Texas 78065

ALL individuals that utilize this ticket for access, including the person that purchased the ticket and the person that utilized said ticket to gain access to the premise. The purchase, acceptance or use of this ticket by any guest shall be deemed acceptance and agreement of the terms and conditions herein.

I understand that Rockberry Ranch / JTR Farms LLC is a working farm, with the attending inherent risks, and hereby release and discharge the farm, its owners, employees, volunteers or agents from any and all liability arising from accident, injury, theft, or damages that may be sustained by me, or to any property belonging to me, while visiting the Farm.

I further agree that I will not sue the farm, its owners, employees, volunteers or agents for any liability arising from accident, injury, theft, or damages that may be sustained by me, or to any property belonging to me, while visiting the Farm.

I am aware of the risks associated with being actively involved in being outdoors, in crop fields, and with animals and being on Rockberry Ranch / JTR Farms LLC property.

I assume all the foregoing risk of using Rockberry Ranch / JTR Farms LLC property and accept personal responsibility for damages resulting from my use, including but not limited to injury, disability or death.

I release, waive and discharge Rockberry Ranch / JTR Farms LLC, employees and volunteers, from any and all liability, to me, my heirs and next of kin for any and all claims, demands, losses or damages, related to my use of Rockberry Ranch property.

I agree to assume full responsibility for any guest whom I bring to Rockberry Ranch/JTR Farms LLC property and will defend and indemnify Rockberry Ranch / JTR Farms LLC against any claim brought by such person.

I understand that the behaviors of animals can be unpredictable and that personal injury or property damage may occur.
I am aware of the risks involved and agree to hold harmless Rockberry Ranch / JTR Farms LLC and/or their employees for any and all personal injury or property damage resulting in my participation.

I understand that animals may carry germs and bacteria that cause disease. I agree to hold harmless Rockberry Ranch / JTR Farms LLC and/or their employees for any and all personal injury or property damage resulting in my participation with animal activities.

I understand that all children under the age of 18 must be directly supervised by an adult at all times while on the farm.
